2. Top Speed Media provides consultancy and information services (the "Service") to those persons ("Users") who utilize its Services.
   
   
3. By using a Service each User agrees to be bound by all of the Conditions of Use set forth in the following paragraphs.
   
   
4. No User may reproduce, or otherwise utilize for commercial purposes, the information provided by Top Speed Media through the Service without the written permission. Consequently, without such written permission, no User may resell or commercially exploit the names, addresses or other data obtained by use of the service.
   
   
5. Each User acknowledges that Top Speed Media has copyrighted the contents of the Service as a compilation copyright and that reproductions, redistribution or publication of such content is prohibited without the express written consent of Top Speed Media.
   
   
6. Top Speed Media reserves the right in its sole discretion to deny access to any User.
   
   
7. By providing information to Top Speed Media, each User hereby grants permission for Top Speed Media to use such information for any purpose unless a restriction on such use is transmitted to Top Speed Media by e-mail prior to such use. Top Speed Media shall not, however sell such information to any person for the purpose of solicitation of any kind. (See the Top Speed Media privacy policy).
   
   
8. Each User agrees to discontinue any communication with persons listed in the Top Speed Media directory upon the request of such persons.
   
   
9. Top Speed Media undertakes no responsibility to review the contents of any information provided to Users, including but not limited to information accessed through links to other sites and forwarded e-mail, and by using the Service each User agrees that Top Speed Media shall have no liability for such contents.
   
   
10. These Conditions of Use may be modified by Top Speed Media at any time by publication through the Service.
    
    
11. Each user expressly agrees that use of the service is at the user's sole risk. Neither Top Speed Media nor any of its licensors, employees, or agents warrant that the service will be uninterrupted or error free; nor does Top Speed Media or any of its licensors, employees or agents make any warranty as to the results to be obtained from use of the service. The service is distributed on an "as is" basis without warranties of any kind, either express or implied, including but not limited to warranties of title or implied warranties of merchantability or fitness for a particular purpose or otherwise, other than those warranties which are implied by and incapable of exclusion, restriction, or modification under the laws applicable to this service. Neither Top Speed Media nor any one else involved in creating, producing, or delivering the service shall be liable for any direct, indirect, incidental, special or consequential damages arising out of use of the service or inability to use the service or out of any breach of any warranty.
